PS2 rock band guitar problem?

so my brother and I just got rock band in August and now we have a problem with the guitar. The problem is that the switch that changes the sound of the echo randomly changes it (the screen appears and echoes changes). when I try to go into overdrive, it does not do that when I deploy the guitar, instead, changes the echo. I have to press the select button for overdrive, which is a pain for me because I always forget notes later. Does anyone have this problem or know what might be causing this? If so, please tell me so I can Maybe my dad fix it so I do not have to buy a replacement! thanks!

You should not have to buy a new one, if you bought in August. Most homes have a 90-day return policy, clearly you have a guitar with a gyroscope defective or malfunctioning buttons or something to that effect. I guess you have that Wal-Mart or Best Buy or any store the main chain should be able to replace it without any problems, as long as you have your receipt.
